Terms of Use

Effective from: 1 December 2026

This is an English translation of the Serbian Terms of Use. In case of differences, the Serbian version prevails.

Srpska verzija

These terms govern the use of the Moj Klijent app (mojklijent.rs). A trainer expressly accepts them when creating an account (the checkbox “I accept the Terms of Use and the Privacy Policy” („Prihvatam Uslove korišćenja i Politiku privatnosti“) and a separate checkbox on responsibility for workouts), and a client by opening the personal link and accepting the notice before the first workout. How we process data is described in the Privacy Policy.

This version introduces card payments through Paddle and the rules on refunds. For accounts created before this version was published, it applies from 1 December 2026. Until then, the version the trainer accepted earlier applies to such an account, and from that day the app asks the trainer to accept the new one (we send an email about the change at least 15 days in advance). A new account accepts this version when the account is created. You can ask us for the earlier version of the Terms (info@mojklijent.rs).

1. About the service

Moj Klijent is an app for personal trainers. In the app, a trainer manages clients, creates and sends workouts and tracks results. A client opens the personal link from the trainer, sets a PIN and enters workout results, even without an internet connection.

The service is provided by Đorđe Milanović PR Računarsko programiranje ByteNS Raševica (hereinafter: the Operator, “we”).

The service is intended for trainers who use it in their work (sole proprietors, companies and trainers who work independently). Any trainer can create an account, free of charge; a paid plan is paid by card or by invoice (see “Plans and payment”).

2. Accounts and access

  • A trainer creates an account on their own, with an email address, a phone number and a password, or through an invitation that we send by email (in that case with the email address the invitation was sent to). The email address is confirmed with a six-digit code sent to that address; an account whose email address is not confirmed within 7 days is deleted. One email address and one phone number can have only one account. The information given at registration must be accurate.
  • When an account is created, we check that the account is not being created by an automated program (a browser check and a limited number of registrations from one IP address).
  • An account created without an invitation receives a sample client with made-up data and a few completed workouts, to show how the app works. The sample client does not count towards the plan and does not receive emails.
  • Keep your password to yourself. The trainer is responsible for actions taken in the account.
  • If you suspect that the account has been misused, let us know immediately.
  • A client accesses the app with a personal link and a PIN. The link and the PIN are personal and are not to be shared. The trainer can create a new link (the old one then stops working) or reset the PIN (the client then sets a new one when opening their link). The PIN is not sent by email.
  • An account cannot be transferred to another person without our consent.

3. Plans and payment

Plans differ only in the number of clients; all features of the app are included in all plans. The free plan is for one client. The paid plans are: up to 5 clients, up to 15 clients, up to 25 clients and a custom plan with the number of clients by agreement.

The number of clients includes active clients and paused clients who have had a workout in the last 7 days. The sample client is not counted.

Plan prices are shown in the app, under Settings → Plan („Podešavanja → Paket“), and on the website. A paid plan is paid in advance, in one of two ways:

  • Individual: by card, as a subscription, monthly or yearly (a yearly subscription costs the same as 10 months). Card payment is not intended for companies and sole proprietors.
  • Company or sole proprietor: by invoice, for 1, 3 or 12 months (for 12 months by invoice you pay as for 10 months). The request is sent in the app, under Settings → Plan → Request an invoice („Traži fakturu“). We activate the plan once an agreement is reached, and it is valid until the date the trainer sees in Settings.

Card payments

  • Card purchases are carried out by our online reseller Paddle.com. Paddle.com is the seller for all card purchases (Merchant of Record): it collects the payment, calculates and remits the tax and issues the receipt. The Paddle buyer terms also apply to the purchase. You enter your card details in Paddle’s payment window; we do not see or store them.
  • The subscription renews automatically, every month or every year from the date of purchase: Paddle then charges the next period to the same card, until you cancel the subscription. The plan is activated and extended automatically when Paddle reports that the payment has gone through.
  • You can cancel the subscription at any time, under Settings → Plan → Manage subscription („Upravljaj pretplatom“). Cancellation takes effect from the next period: the paid plan remains valid until the end of the paid period, and after that the free plan applies. Until the end of the paid period, you can undo the cancellation with the “Resume subscription” („Nastavi pretplatu“) button on the Plan page; the subscription then renews as before.
  • A larger plan applies immediately: Paddle immediately charges the price difference for the rest of the paid period. A smaller plan applies from the next period; until then, the paid plan remains valid.
  • You switch from a monthly to a yearly subscription, for the same or a larger plan, immediately (you pay the yearly price, reduced by the unused part of the month). You switch from a monthly subscription to a smaller plan billed yearly in two steps: first you choose that plan monthly, and after the renewal you switch to yearly. You switch from a yearly to a monthly subscription only when the paid year expires: you cancel the subscription (the paid plan remains valid until the end of the paid year), and after it expires you choose a plan monthly. Between the expiry and the new purchase, the free plan applies; nothing is deleted.
  • If a renewal fails (for example, the card has expired), the plan remains valid for 7 more days after the end of the paid period, and Paddle retries the charge for up to 14 days. You change the card in “Manage subscription”. If the payment does not go through within 7 days, the free plan applies. If a later attempt does succeed, the paid plan is activated again, and the paid period is counted from the day of the renewal, even though the free plan applied for a few days. If no attempt succeeds, Paddle cancels the subscription.
  • When you delete your account, the subscription is cancelled immediately (see “Ending use of the service” and “Refunds”).

Prices and tax

  • Card prices are final and include VAT: tax is included in the price, and Paddle calculates the tax.
  • By invoice you pay the same amounts, without VAT: VAT is not charged (Article 33 of the Law on Value Added Tax).
  • The price of a paid period does not change until the end of that period.

When a paid plan expires, the free plan applies. When a plan expires or is changed to a smaller one, nothing is deleted: the trainer sees all clients and past workouts, and clients see theirs. A new client cannot be added then, and the trainer sends new workouts only to the clients within the plan (the first ones added, up to the number of clients in the plan).

No money is refunded for the unused part of a period, even when you cancel the subscription or delete your account, except under the rules in the section “Refunds”.

4. Refunds

For card payments, we refund the full amount of the first payment if you request a refund within 14 days of the first payment. Together with the first payment, we also refund the additional payments for a larger plan from the same period. This rule applies to both monthly and yearly subscriptions.

  • You request a refund by email to info@mojklijent.rs, from the email address of the account. We refund the money through Paddle, using the same payment method (the card or another method that Paddle offered); it takes the bank a few days for the amount to appear in your account.
  • After a refund, the subscription is cancelled, the paid plan (and the larger plan from the additional payment) stops being valid and the free plan applies. Nothing is deleted.
  • Renewals are not refunded, unless the law requires otherwise. A renewal is every subsequent monthly or yearly charge; to avoid being charged, cancel the subscription before the end of the paid period.
  • A payment by invoice is not refunded for the unused part of the period.

This does not limit the rights you have under the law (for example as a consumer), nor the right to a refund when the service did not work through our fault.

5. Acceptable use

The following is not allowed:

  • using the app for unlawful purposes or for content that insults, threatens or infringes the rights of others;
  • entering other people’s data without a lawful basis;
  • attempting unauthorised access to other people’s accounts or data and circumventing protection (for example guessing PINs);
  • disrupting the operation of the app, overloading it, creating accounts automatically and collecting data automatically;
  • sending unsolicited messages through the app’s email features;
  • selling or transferring access to third parties.

If the rules are broken, we may restrict or close the account (see “Ending use of the service”).

6. Trainer’s responsibility for client data

The trainer is the controller of the data of their clients. This means that the trainer is responsible for:

  • a lawful basis for every item of data the trainer enters. Health data (limitations, injuries, measurements) is entered into the app by the trainer, and the basis is, as a rule, the client’s explicit consent, which the trainer obtains and can prove. The app does not check or record the consent;
  • informing the client about the processing of data (it is enough to refer the client to the Privacy Policy);
  • entering only the data that is needed to plan and track workouts;
  • the accuracy of the data and deleting it when it is no longer needed;
  • responding to clients’ requests (access, correction, deletion), with our help;
  • the consent of a parent or legal guardian for clients who are minors;
  • respecting a client’s choice to unsubscribe from emails;
  • the content of the workouts and messages the trainer sends to clients and whether a programme is suitable for the client.

We do not review the content that the trainer enters.

7. Processing data on behalf of the trainer

This section is the data processing agreement between the trainer (controller) and the Operator (processor), in accordance with the law on personal data protection.

Subject matter and duration
Processing of client data for the purpose of providing the service, for as long as the trainer uses the app and until the data is deleted under these terms.
Nature and purpose of processing
Storage, display, transfer to the client, sending emails on the trainer’s behalf and backups. Purpose: managing clients and workouts.
Types of data and data subjects
Data about the trainer’s clients listed in the Privacy Policy, including health data if the trainer enters it.

The Operator undertakes to:

  • process the data only on the trainer’s instructions (these terms and the app features the trainer uses), unless the law requires otherwise;
  • ensure that the persons who have access to the data are bound by confidentiality;
  • apply the security measures described in the Privacy Policy;
  • engage sub-processors (Railway and Resend) under a contract with the same data protection obligations. The trainer gives a general authorisation for them. We give advance notice of a change of sub-processors, and the trainer can object by ceasing to use the service;
  • help the trainer respond to data subjects’ requests and meet legal obligations (for example exporting or deleting individual items of data; there are no buttons for this in the app, so we do it manually, on request);
  • notify the trainer of a data breach without undue delay, so that the trainer can notify the Commissioner for Information of Public Importance and Personal Data Protection within 72 hours when this is required;
  • delete the data when the service ends: immediately, when the trainer deletes the account in Settings, or at the trainer’s request within 30 days at the latest (and, on request, return it to the trainer before deletion), unless the law requires it to be kept;
  • on request, provide the information the trainer needs to verify compliance with these obligations.

8. Trainer’s responsibility for workouts

Workouts in the app are created by the trainer, not by the Operator. The trainer accepts this section with a separate checkbox when creating an account, and a trainer with an account created earlier does so the first time they open the app after this change. The trainer declares, and is responsible for, the following:

  • the trainer has the knowledge and experience to train people and, where regulations require it, the appropriate professional qualification or licence;
  • the trainer independently assesses the client’s health, abilities and readiness and adapts the workouts accordingly;
  • the trainer informs the client about the risks of exercise;
  • the trainer is responsible for the workouts and advice the trainer gives to clients.

The Operator does not select, vet or supervise trainers, their qualifications or their workouts. The app only transmits workouts from the trainer to the client and results from the client to the trainer.

If a client or a third party makes a claim against the Operator because of the trainer’s workouts, advice or content, the trainer compensates the Operator for the damage and reasonable costs, including the costs of legal representation.

9. Workouts and health

The app is a tool for managing and recording workouts. It does not give advice on training, nutrition or health and is not a medical device. Workouts are created by the trainer, who is responsible for them (see “Trainer’s responsibility for workouts”). The Operator does not vet trainers or workouts.

Before exercising, especially if you have injuries or health problems, consult a doctor. Exercise within your abilities and stop if you feel pain, dizziness or weakness.

Before the first workout, the client sees the notice “Before you start” in the app and must accept the notice. Until the notice is accepted, the app does not show any workout. When the notice changes significantly, the client accepts the new version.

10. Exercise content

The app has an exercise library with names, descriptions of how to perform the exercises and images. That content is general guidance and is for information only. Every body is different, so an exercise description is not a rule, but an aid in working with the trainer.

  • We do not guarantee that exercise names, descriptions and images are complete, accurate or suitable for every person. Technique, range of motion and how an exercise feels differ from person to person.
  • The images are illustrations (some may be computer-generated, with the help of artificial intelligence) and do not necessarily show the correct technique.
  • Exercise content is not medical advice and does not replace an assessment by a trainer or a doctor.
  • The trainer chooses the exercises for the client and is responsible for how the trainer applies them to the client (see “Trainer’s responsibility for workouts”). The trainer is responsible for their own exercises and the links to video recordings that the trainer enters.
  • The client follows the trainer’s instructions and stops an exercise if something hurts or does not feel right.

That is why, next to the steps of each exercise in the app, there is a short note that the description is general guidance, not a rule.

11. Availability of the service

We provide the app “as is”. We do our best for it to work reliably, but we do not guarantee that it will work without interruptions or errors. Maintenance and changes (new features, removal of features) are possible.

Working without internet

Working without internet depends on the device. The browser may delete local data (for example when storage runs low or after a long period without use), so results that have not been sent yet may be lost. That is why you should send results as soon as you have internet.

Database backups are made according to the settings of the hosting provider (Railway). We do not guarantee that every item of data can be restored.

12. Limitation of liability

To the extent permitted by law, the Operator is not liable for:

  • indirect damage and lost profit;
  • the health consequences of exercise and plans created by the trainer;
  • content entered by trainers;
  • the incompleteness or inaccuracy of exercise descriptions and images and the consequences of applying that content (see “Exercise content”);
  • loss of data due to circumstances beyond our control (for example a failure of a device or a service provider, force majeure);
  • the consequences of sharing the link or the PIN with other persons.

The total liability of the Operator is limited to the amount of the fees the trainer has paid for the service in the last 12 months, and, if the service is not paid for, it is limited to the greatest extent permitted by law.

Nothing in these terms excludes liability for damage caused intentionally or through gross negligence, nor rights that cannot be excluded or limited under the law (including consumer rights, if the trainer is a consumer).

13. Content and rights

The app, the design and code of the app, and the exercise library (descriptions and images) belong to the Operator or to the rights holders and may be used only through the app.

Content that the trainer enters (workouts, names, notes, links) remains the trainer’s. The trainer gives us the right to store and display that content, solely for the purpose of providing the service.

14. Ending use of the service

The trainer can stop using the app at any time and delete the account: Settings → Delete account („Obriši nalog“), with password confirmation. Deletion is immediate and permanent: the account is deleted together with the clients and their links, workouts and results, templates, own exercises and measurements, and the clients receive an email that their link no longer works. Deletion can also be requested at info@mojklijent.rs; in that case we carry out the deletion within 30 days at the latest, and before deletion, on request, we provide the data in a commonly used format. Deleting the account, in the app or on request by email, immediately cancels the card subscription (see “Refunds”).

We may block or close an account, with notice, if these terms are breached, if there is a security risk or if the agreed fees are not paid. In urgent cases (misuse, security) we may also do so without prior notice. A blocked account cannot sign in, and the data remains until the account is unblocked or deleted. When we block an account, we cancel the card subscription with effect from the end of the paid period at the latest (if the payment is overdue or paused, immediately), so Paddle does not charge anything after that.

15. Changes to these terms

We may change these terms, for example because of new features or regulations. We notify trainers of significant changes by email or in the app at least 15 days before they start to apply, and the next time you open the app, it asks you to accept them. If you do not agree with the changes, you can stop using the app and delete your account.

16. Governing law and disputes

The law of the Republic of Serbia applies. We first try to resolve disputes amicably. If that does not succeed, the court with subject-matter jurisdiction in Paraćin has jurisdiction.

If the trainer is a consumer, these terms do not limit the trainer’s rights under consumer protection regulations. If any provision is invalid, the other provisions remain in force.
